Can You Start Your Own Business In Canada ?
Any non-resident or non-citizen can start a business in Canada, but he or she must become partners with a permanent resident or Canadian citizen and hire permanent residents or citizens to work in the business. If the business is a corporation a number of directors must be Canadian residents in accordance with federal or provincial law. A corporation may be formed under federal law if it will operate nationally in every province, but must register with every province as an extra-provincial company. Provincial incorporation is therefore the preferred method of incorporation.
Can You Open A Branch Office In Canada ?
If you have an existing business you can open a branch office in Canada but you must register with the province of activity as an extra-provincial corporation. Again, you must have an agent who is a permanent resident or Canadian citizen and comply with that province’s law related to the number of resident directors.
In the above cases you cannot work legally in your Canadian branch or new business unless you obtain permanent residence (immigrant status) or work permit in accordance with Canada immigration laws.
